Refusal or rejection in whatever aspect of our lives hurts – a feeling no one wants to experience ever in their life. For visa applicants, refusal could be the worst scenario particularly if one has already set life in Australia.
The common question that we received when a refused visa applicant approach our office is "can I appeal the decision?" Or "who has the eligibility for a review right? "
In a general sense, a refused application that was made in Australia is entitled to review rights. This means that the visa applicant himself/herself or through his lawyer or RMA may apply for the review of the decision to refuse or cancel the visa.
If the visa applicant is overseas and was refused an application – the Australian sponsor or family member mentioned in the application may make the application for review. The Australian sponsor or family may act as are view applicant while the person who applied will remain to be a visa applicant. Historically, there has been a high percentage of review application that gets remitted, vacated, or corrected so that a visa applicant is granted a visa to come to Australia.
